OurStay Vacations Direct‑Booking Terms of Service

These Direct‑Booking Terms of Service (“Terms”) are a binding agreement between OurStay Vacations (“OurStay,” “we,” “our” or “us”) and anyone who uses our direct‑booking website or services (“you” or “Guest”). By accessing or using the OurStay website, completing a reservation with OurStay, or staying at one of our properties, you agree to these Terms. If you do not agree to these Terms, do not use OurStay’s direct‑booking services.

1 • Scope and Definitions

  • OurStay platform. OurStay operates a direct‑booking website and related services to allow Guests to search for and reserve accommodations managed by OurStay.

  • Guest. A person who searches, books, or stays in an OurStay property through our direct‑booking platform.

  • Listing. A description of a property available for booking, including amenities, price, cancellation policy, house rules and occupancy limits. By booking a Listing you form a contract with OurStay for the provision of a stay.

  • Total price. The reservation price shown at checkout, which may include nightly rates, cleaning fees, taxes and other charges.

  • House rules. Additional conditions that apply to a specific property and are displayed on the Listing page and during checkout.

  • Major disruptive event. Extraordinary circumstances beyond your control—such as natural disasters or government travel restrictions—that make it impractical or illegal to complete your stay.

2 • Using OurStay: Searching, Booking, and Term

  • Searching. You can search OurStay listings by location, date, number of guests and other criteria.

  • Booking and term. When you book a Listing you agree to pay the Total Price and any other items identified during checkout. Reservations generally begin at 4:00 pm local time on your arrival date and end at 10:00 am local time on your departure date. Subject to availability, stays may be shortened or extended only with OurStay’s written confirmation and payment of any additional fees.

  • Identification and age. You must be at least 18 years old and able to enter legally binding contracts to book an OurStay property.

  • Payment processing. All payments are processed through OurStay’s payment provider. We may pre‑authorize your credit card for a security deposit and charge your card for the Total Price and any damage costs or overstay fees.

3 • Occupancy, Non‑Disturbance and Use

  • Limited occupancy. Occupancy is limited to the number of guests specified on your booking. All guests staying on the property must be listed on your reservation. Additional guests not included in the reservation are subject to approval and may incur extra fees.

  • No tenancy or landlord‑tenant relationship. Regardless of the length of your stay, your reservation grants you a revocable license to occupy the property on a temporary basis. This license does not create a lease or any landlord‑tenant relationship. You do not acquire any tenancy, property interest or right of possession under state or local law. You must vacate the property at the end of your booking; if you remain, you will be considered a trespasser and may be removed immediately.

  • Non‑disturbance and lawful use. You and your guests agree not to disturb, annoy, endanger or inconvenience neighbors. Quiet hours are strictly enforced from 10:00 pm to 8:00 am.

  • No subletting or assignment. You may not sublet, assign or transfer your reservation without OurStay’s prior written consent.

  • Temporary use only. Your stay is short‑term and transient. The property is not your home or permanent residence, even if you book for more than 30 days.

  • House rules and specific restrictions. You agree to abide by all posted house rules, including restrictions on pets, smoking, parties, decorations and noise, as outlined below.

4 • Care of Premises and Amenities

  • General care and damages. Leave the accommodation and common areas in the condition they were in when you arrived. Lock all doors and windows whenever you leave.

  • Damages and cleaning fees. You agree to pay for any damages to furnishings, household items, structures or pools resulting from your stay, and for any additional cleaning charges beyond normal wear.

  • Pets. Our properties are pet‑friendly only when designated as such. You must add each pet to your reservation at the time of booking. We allow only two pets per stay. Pet fees will be charged at booking; if pets are brought without being added to the reservation or the fees are unpaid, we will request payment. Pets must not be on furniture or in pools, and pet waste must be removed; failure to pick up waste may result in a fee. Unauthorized pets are grounds for immediate eviction without refund.

  • Smoking. Smoking of any kind is strictly prohibited inside the property. Smoking is allowed only in designated outdoor areas and cigarette remnants must be disposed of properly. Evidence of indoor smoking may result in a minimum cleaning fee and forfeiture of your deposit.

  • Pool heating. Not all properties have a pool heater, and pool‑heating policies vary by property. Some pools may be unheated, some may have a different baseline temperature than 80 °F (26.7 °C), and some may require an additional fee even to heat at all. Where pool heating is available, it may be subject to seasonal restrictions, local regulations, or extra fees. Please refer to the specific listing for full details on whether the pool is heated, the default temperature, and any additional costs or limitations.

  • Crib / Pack N' Play. Some properties include a Portable Crib, which serves as a pack‑n‑play and travel crib. We provide sheets, but you are responsible for bringing your own childcare essentials. We do not provide a traditional full‑size crib.

  • Heating & cooling. You have full control over the thermostat during your stay and may adjust it to your comfort. Our HVAC systems include preset limits to protect the equipment from potential strain or damage; please do not attempt to override or tamper with these settings.

  • Discrepancies and refund policy. If there are any issues with the cleanliness of the property or its amenities, you must notify OurStay immediately upon arrival so we can address them. We will not provide refunds or discounts for issues reported after your stay has been completed or for factors outside our control (e.g., natural disasters). No refunds or discounts will be issued if complimentary amenities such as the pool, pool heater, hot tub, hot tub heater or similar equipment require repairs or are temporarily shut down. Refunds will only be considered for additional paid services that were unavailable. All other amenities not essential for the property’s livability are considered complimentary and are not eligible for refunds or discounts.

5 • Cancellation, Refunds and Booking Modifications

  • Guest cancellations. If you cancel a reservation, refunds will be processed according to the cancellation policy displayed on your reservation.

  • OurStay cancellations and reservation issues. If OurStay cancels or a property becomes uninhabitable, we will attempt to provide a comparable property or may provide a full refund.

  • Booking modifications. Any change in dates or number of guests requires OurStay’s written approval and may incur additional charges.

  • No‑shows and early departures. Failure to check in or leaving early does not entitle you to a refund.

6 • Check‑In, Check‑Out and Overstay

  • Standard times. Standard check‑in time is 4:00 pm and check‑out time is 10:00 am, unless stated otherwise.

  • Important cleaning window. Many properties require five to six hours to clean and prepare between reservations. We cannot accommodate early check‑in or late check‑out in advance. Please be patient while our team prepares the property for your stay. If the property becomes available earlier on your check‑in day, we will notify you on the day of your arrival.

  • Overstay, trespass and removal. If you remain on the property past your check‑out time or otherwise occupy the property beyond the agreed term, you are not a tenant and have no legal right to remain. You may be charged an overstay fee (including the published daily rate plus additional penalties) and will be treated as a trespasser subject to immediate removal. OurStay reserves the right to reenter and repossess the property, remove you and your belongings, and change locks, as permitted by law.

7 • Limitation of Liability and Indemnification

  • OurStay’s role and liability. OurStay provides accommodations and manages reservations but is not liable for any injuries or losses, except where caused by OurStay’s gross negligence or willful misconduct.

  • Indemnification. You agree to indemnify and hold OurStay, its owners and agents harmless from any claims or damages arising from your breach of these Terms or your use of the property.

8 • Modifications to these Terms

We may modify these Terms at any time. Updated Terms will be posted on our website with a new “Last updated” date. Continued use of the OurStay platform constitutes acceptance of the revised Terms.

9 • Governing Law, Arbitration and Dispute Resolution

  • Governing law. Because OurStay manages properties in multiple states, the governing law for each reservation will be the law of the state where the property is located, without regard to conflict‑of‑laws principles.

  • Arbitration. Any disputes arising out of or relating to these Terms or your reservation will be resolved exclusively by binding arbitration, except that either party may bring an individual action in small‑claims court if eligible. Arbitration will be administered by a recognized arbitration provider (e.g., the American Arbitration Association) and held in the state where the property is located. You waive the right to a jury trial and to participate in class actions. This arbitration provision survives termination of these Terms.
